What are cookies?
Cookies and other similar technologies (local shared objects or flash cookies, web beacons or bugs, etc.) are data storage and retrieval devices that the service provider installs on users’ terminal equipment to ensure the website works correctly.
By using these devices, the web server is able to remember certain data about the user, such as their preferences for displaying the pages of that server, username and password, the products they are most interested in, etc.

Types of cookies:
a) By entity:
Depending on which entity manages the equipment or domain from which the cookies are sent and processes the data obtained, we can distinguish:
- First-party cookies: are those sent to the user’s terminal equipment from a device or domain managed by the publisher itself and from which the service requested by the user is provided.
- Third-party cookies: are those sent to the user’s terminal equipment from a device or domain that is not managed by the publisher but by another entity that processes the data obtained through the cookies.
Where cookies are served from a device or domain managed by the publisher itself, but the information collected through them is managed by a third party, they cannot be considered first-party cookies if the third party uses them for its own purposes (for example, improving the services it provides or providing advertising services on behalf of other entities).
b) By purpose:
There are many purposes for the use of cookies. Depending on the purpose for which the data obtained through cookies is processed, some of the purposes may be:
- Technical cookies: are those that allow the user to browse a website, platform or application and to use the different options or services available on it, including those the publisher uses to manage and operate the website and enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remembering the items in an order, carrying out the purchase process of an order, managing payment, controlling fraud linked to the security of the service, processing a request to register for or take part in an event, counting visits for the purpose of billing software licences, using security features while browsing, storing content for broadcasting video or audio, enabling dynamic content (for example, loading animation of a text or image) or sharing content through social networks.
Also belonging to this category, due to their technical nature, are those cookies that allow the most efficient management of the advertising spaces which, as a further element of design or “layout” of the service offered to the user, the publisher has included on a website, application or platform based on criteria such as the edited content, without collecting information about users for other purposes, such as personalising that advertising content or other content.
Technical cookies will be exempt from compliance with the obligations established in article 22.2 of the LSSI when they enable the service requested by the user to be provided, como ocurre en el caso de las cookies enumeradas en los párrafos anteriores. Sin embargo, si estas cookies se utilizan también para finalidades no exentas (por ejemplo, para fines publicitarios comportamentales), quedarán sujetas a dichas obligaciones.
- Preference or personalisation cookies: are those that allow information to be remembered so that the user accesses the service with certain characteristics that may differentiate their experience from that of other users, such as the language, the number of results to display when the user performs a search, the appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which they access it, etc. If it is the user who chooses those characteristics (for example, if they select the language of a website by clicking on the corresponding country flag icon), the cookies will be exempt from the obligations of article 22.2 of the LSSI as they are considered a service expressly requested by the user, provided that the cookies serve exclusively the selected purpose.
- Analysis or measurement cookies: are those that allow the party responsible for them to monitor and analyse the behaviour of users of the websites to which they are linked, including quantifying the impact of advertisements. The information collected through this type of cookie is used to measure the activity of the websites, application or platform, in order to introduce improvements based on the analysis of usage data made by users of the service. To use these cookies, the user’s consent must be requested.
- Behavioural advertising cookies: are those that store information on users’ behaviour obtained through the continuous observation of their browsing habits, which makes it possible to develop a specific profile in order to display advertising based on it. To use these cookies, the user’s consent must be requested.
c) By how long they stay active on the terminal device:
- Session cookies: are those designed to collect and store data while the user accesses a website. They are usually used to store information that is only of interest to keep for the provision of the service requested by the user on a single occasion (for example, a list of purchased products) and disappear when the session ends.
- Persistent cookies: are those in which the data remains stored on the terminal and can be accessed and processed for a period defined by the party responsible for the cookie, which may range from a few minutes to several years.
Processing of personal data through cookies
